1. Distributor Status & Warranty Disclaimer Safewerks acts solely as a distributor and is not the manufacturer of the products we sell. Therefore, we do not conduct product testing and are not liable for product reliability, manufacturing defects, or claims made by the manufacturers. DISCLAIMER OF WARRANTIES: ALL PRODUCTS ARE SOLD "AS IS." SAFEWERKS EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Any applicable warranties are strictly limited to those provided by the original manufacturer. 2. Website Accuracy Because manufacturers frequently update their products, materials, and safety standards, Safewerks cannot guarantee that all product descriptions, images, or specifications on our website are 100% accurate or current. All information is provided for general reference only. Customers are strongly encouraged to refer to the manufacturer’s official website, product manuals, or data sheets for the most precise and up-to-date information before purchasing.

3. Order Acceptance, Cancellation, and Fraud prevention Safewerks reserves the right, at our sole discretion, to refuse or cancel any order for any reason. This includes, but is not limited to, cancellations due to errors in pricing, inaccurate product descriptions, or inventory shortages. Furthermore, for the protection of our customers, any transaction flagged as a high risk of fraud by our payment processing system will be automatically canceled and voided.

ANY APPLICABLE WARRANTY IS STRICTLY LIMITED TO THE EXPRESS WARRANTY PROVIDED BY THE ORIGINAL MANUFACTURER.

LIMITATION OF LIABILITY: IN NO EVENT SHALL SAFEWERKS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO COSTS OF THIRD-PARTY CUSTOMIZATION, LOST PROFITS, OR DELAYS, ARISING OUT OF OR IN CONNECTION WITH THE SALE, USE, OR INABILITY TO USE OUR PRODUCTS. SAFEWERKS’ TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE OF THE SPECIFIC GOODS GIVING RISE TO THE CLAIM.

INSPECTION AND ALTERATIONS: The customer is responsible for inspecting all goods immediately upon receipt for accuracy, defects, and shortages before any use or alteration. If a product is modified, altered, washed, or customized by the customer or a third party (including but not limited to screen printing, embroidery, heat pressing, or sewing), all return privileges and warranties are immediately voided. Safewerks assumes no liability for garments damaged during third-party decoration processes.

CLAIMS FOR DEFECTS OR SHORTAGES: Any claims for shortages, visible defects, or incorrect items must be reported to Safewerks in writing within five (5) business days of delivery. Failure to report issues within this timeframe constitutes full acceptance of the goods as delivered. Latent manufacturing defects must be addressed directly with the manufacturer in accordance with their specific warranty periods.

GOVERNING LAW AND JURISDICTION: These Terms of Service, and any separate agreements whereby Safewerks provides you products or services, shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles.

By purchasing from Safewerks, you agree that any legal suit, action, or proceeding arising out of or related to these Terms of Service or your purchase shall be instituted exclusively in the state or federal courts located in Pima County, Arizona. You hereby irrevocably consent to the exclusive jurisdiction and venue of such courts and waive any objections to such jurisdiction or venue, including objections based on forum non conveniens (an inconvenient forum).
